The Mobility Metropolis – The website www.lametropolemobilite.fr and the Mobility Metropolis application

Article 1 - Purpose

These general online sales conditions (hereinafter referred to as the “general conditions”) are concluded:

For the “Pass Intégral” Aix-Marseille-Provence products between the Aix-Marseille-Provence Metropolis, associated with the Provence Alpes Côte d’Azur Region, and the customer,

For mobility products available for sale online between the Aix-Marseille-Provence Metropolis and the customer,

For electronic transport tickets on sale on le ticket / lMétropole Mobilité application, the specific conditions of sale are described in appendix 1.

The website www.lametropolemobilite.fr and the Métropole Mobilité app allow customers to top up their contactless card for travel tickets/season tickets after paying online by credit card.
Customers are advised that top-ups paid electronically will be effective one hour after purchase.
The ticket must be loaded onto the card within 30 days of purchase. After this period, the ticket can no longer be downloaded or used.

To activate the purchased product, the card must be presented:

  • Bus station Bus de l’Etang, Pierre Plantée in Vitrolles,
  • Libébus agencies, Place Morgan in Salon-de-Provence,
  • Ulysse Boutique, Bus Station in Istres,
  • Ulysse Boutique, Rue Boze in Martigues,
  • Ulysse Boutique, SNCF train station in Miramas,
  • Ciotabus bus station in La Ciotat,
  • SNCF station

or on the metro/tramway and high-level bus service (BHNS) distributors of the RTM and Aix en Bus network

or on the bus desks of the networks: Libébus, Aix en Bus, Cigales, Collines, Côte Bleue, Marcouline and Ciotabus.

Article 2 - Definitions

Each of the terms mentioned below has, in these general conditions, the meaning given to it, namely:

  • customer : the customer means the user of the Métropole Mobilité application or the Internet user, using the sales area of ​​the lametropolemobilite.fr, website, the websites of transport and mobility service operators acting on behalf of Métropole Mobilité and the Métropole Mobilité applications (including the former leticket application).
  • seller : the seller designates the Aix-Marseille-Provence Metropolis, EPCI, registered with the Marseille Trade and Companies Register under number 200 054 807 00074, whose registered office is located at 57, Boulevard Charles Livon, 13007 Marseille.
  • top-up : top-up means making transport tickets/subscriptions available on any contactless card whose number appears in the ATLAS customer base and held by the customer.
  • ATLAS customer base : database of customers of the digital system supporting ticketing services enabling the sale of transport tickets online.
  • support card: means the contactless card support held by the customer.
  • website : the lametropolemobilite.fr website
  • application : the application designates the La Métropole Mobilité application.
  • Transport ticket: the contract between the customer and:
    Transport and mobility service operators acting on behalf of the Aix-Marseille-Provence Metropolis, associated with the Provence Alpes Côte d’Azur Region for “Pass Intégral” products.
    Transport and mobility service operators acting on behalf of the Aix-Marseille-Provence Metropolis, for metropolitan mobility products.
  • order : the purchase of transport tickets (chargeable or rechargeable on the contactless card), made and paid for by the customer on the lametropolemobilite.fr website or the La Métropole Mobilité application.
  • fixed distributors and/or validators: terminals which allow the remote distribution of transport tickets ordered by the customer on the lametropolemobilite.fr website or the La Métropole Mobilité application.
  • teledistribution : recovery or activation of transport tickets ordered by the customer on the lametropolemobilite.fr website or the La Métropole Mobilité application by placing the card on the equipment provided for this purpose.

Article 3 - Scope of application

Any order implies the customer’s unreserved acceptance of the general terms and conditions. These general terms and conditions are accessible via a hyperlink on the website www.lametropolemobilite.fr, the La Métropole Mobilité application (including the former leticketapplication). The customer is advised to download and/or print them and keep a copy. The customer is also invited to read the contractual conditions immediately before entering into the electronic contract, as these conditions are subject to change without notice.

Article 4 - Capacity

The customer declares that he or she has the capacity to enter into this contract, i.e., that he or she is at least 18 years old, legally capable of entering into a contract and using this site in accordance with these general terms and conditions. He or she declares that he or she is not under guardianship or curatorship.

Any fraudulent use of the site or use that contravenes these general conditions could result in the Aix-Marseille-Provence Metropolis refusing the sale of transport tickets at any time.

Article 5 - Procedure to be followed by the customer

The online purchase for loading or reloading a transport ticket onto lacarte takes place in the following steps:

  • the customer must first be identified as an existing customer in the ATLAS database using their lacarte card or any other card with a logo confirming its compatibility (card number and date of birth of the card holder).
  • the customer selects the transport ticket(s)/subscription(s) that he wishes to load or top up on his device.
  • The customer sees the summary of their order in their basket: selected transport ticket(s)/subscription, total amount of their order. They can add or remove an item from their basket and correct any input errors.
  • The customer accepts these general conditions by checking the box stating that they unreservedly accept the terms, as stipulated at the time of confirmation of their order and their expression of acceptance of the offer from the Aix-Marseille-Provence Metropolis. These general conditions are accessible via a hyperlink on the website and on the application. The customer is advised to download and/or print them and keep a copy and must read them just before concluding the electronic contract, as these conditions are subject to change without notice. They therefore acknowledge having read the Public Operating Regulations for all transport networks and mobility services that can be used with the purchased ticket.
  • the customer confirms his top-up request by clicking on the “Confirm order” link.
  • on the website, the customer confirms or completes their billing email address, on the mobile application the user account email address is used for the
  • The customer then provides information relating to their credit card payment method on the secure site. The customer will ensure that they provide reliable and authentic information during the various stages of their order.
  • A payment confirmation message will appear on the screen.
    The sales contract is then validly concluded between the customer and the transport and mobility service operators acting on behalf of the Aix-Marseille-Provence Metropolis associated with the Provence Alpes Côte d’Azur Region for the products concerned.
  • The loading of transport tickets/subscriptions is not carried out directly online on the device on which the purchase and payment were made, but rather in a deferred manner within a minimum period (see Article 1).

The procedure for purchasing dematerialized securities online can be found in Appendix 1: Special conditions for the sale of dematerialized securities.

Article 6 - Price

The prices of transport tickets/season tickets are expressed in euros and include all taxes. Prices are subject to change at any time. The prices in effect on the date of the order are those mentioned on the website www.lametropolemobilite.fr and on the application and included in the customer’s order summary.

Any change in the VAT rate will be automatically reflected in the price of transport tickets.

Article 7 - Payment

The only payment method accepted is bank card.

Payment for transport tickets/subscriptions ordered by the customer on the website www.lametropolemobilite.fr; the La Métropole Mobilité La Métropole Mobilité application (including the old leticketapplication) is made by cash payment by credit card, Visa, Mastercard, accepted in France, using a secure payment system PAYZEN with the 3D secure option. It is specified that the seller does not store under any circumstances the banking data linked to the payment of the order.

The data recorded by the payment system constitutes proof of all transactions carried out by the Aix-Marseille-Provence Metropolis, its customers and the banking establishment.

Article 8 - Confirmation of the order

Following confirmation of the order and validation of payment, the seller will send the customer an online payment receipt by email to the address designated by the customer, which constitutes confirmation of the sale.

The customer is advised to keep and/or print these electronic messages, as they constitute proof of their order and the successful completion of the online purchase. The parties expressly declare that electronic mail and data exchanged electronically will have the value of written proof between them and waive the right to require any confirmation by mail.

Article 9 - Withdrawal period

In the context of an online sale, under the terms of article L121-20-4 of the Consumer Code, the consumer’s right of withdrawal is not applicable for contracts relating to transport services provided on a specific date or at a specific frequency.

The customer’s order is therefore deemed firm, definitive and irrevocable, given the online provision of this type of service.

Article 10 - Termination of the contract

Article 10.1 No refunds will be made for any tickets sold on the La Métropole Mobilité applications (including the old leticketapplication).

Article 10.2 The contract is terminated automatically by the seller and the chip card blocked, without any particular formality, in the following cases:

  • In the event of fraud established in the constitution of the
  • In the event of proven fraud in the use of the title of
  • In the event of rejection by the banking establishment of a payment.

Article 10.3 The seller reserves the right to refuse any new subscription to a beneficiary whose subscription contract has already been terminated for the reasons specified in article 10.2.

Article 11 - Complaints

By accepting the terms of this contract, the customer acknowledges accepting the specific conditions attached to each of the titles upon purchase.

Any complaints must be addressed via the contact form.

The seller undertakes to process any complaints as quickly as possible.

Article 12 – Personal data

Personal data collected on the Métropole Mobilité application and processed by the Métropole d’Aix-Marseille-Provence

Article 13 - Applicable law, attribution of jurisdiction

Any dispute relating to these general conditions and, more generally, to all purchases made on the website www.lametropolemobilite.fr, the La Métropole Mobilité application (including the former leticketapplication) is subject to French law applicable to distance selling and the jurisdiction of the courts of Marseille.

APPENDIX 1: SPECIAL CONDITIONS OF SALE OF DEMATERIALIZED TRANSPORT TICKETS

Annex 1 - Article 1: Purpose

These special conditions of sale (hereinafter referred to as the “Special Conditions”) are concluded between the Métropole Aix-Marseille-Provence and a Customer (hereinafter referred to as “the Customer”), in the context of the distance sale, via the La Métropole Mobilité mobile application (including the former leticket application) for smartphones, of dematerialized transport tickets valid on the Métropole Mobilité networks serving the territory of the Métropole Aix-Marseille-Provence (hereinafter referred to as “the Transport Tickets”).

The purchase of the electronic transport ticket is reserved for customers who have read the Special Conditions in their entirety, prior to each order: any purchase implies unreserved acceptance by the Customer of the General Conditions of Sale and these Special Conditions.

Appendix 1 - Article 2: Terms of access to the service

Access to the service is possible 24 hours a day, 7 days a week, except in cases of force majeure or an event beyond the control of the Aix-Marseille-Provence Metropolis and subject to any breakdowns and maintenance work necessary for the proper functioning of the service and equipment.

The Aix-Marseille-Provence Metropolis may be required to interrupt the service or part of the service for maintenance reasons, without the right to compensation.

To access the service, the Customer must create an account or log in to an existing account using the La Métropole Mobilité applications (including the old leticketapplication). The Customer is liable for any fraudulent use of their login details (email address and password combination) by a third party.

Appendix 1 - Article 3: Order

The order process takes place in the following steps:

The order is made in real time from the La Métropole Mobilité mobile application (including the old leticketapplication) which informs the customer about the availability of transport tickets at the time of the purchase transaction.

As a preliminary step, the Client identifies himself using a username and password in

“My Account.” Creating a “My Account” account is free and mandatory. Of course, if the customer already has a mobility account, creating an account is not necessary.

Once identified, the Customer selects the transport title(s) they wish to purchase, after consulting the terms and conditions applicable to their use. When his choice is made, the customer displays the list of transportation tickets available for sale on the La Metropole Mobility mobile app (including the old leticketapp), as well as their fares.

  • The Customer clicks on the selected shipping title.
  • The Customer shall take notice of and accept the General and Specific Conditions of Sale applicable to the Dematerialized Securities.
  • The Customer knows the information relating to the
  • The Customer shall proceed to the online payment in a secure manner as defined in Article 7 of the General Conditions of Sale. The contract of sale is therefore validly concluded between Metropole Aix-Marseille Provence and the Customer.
  • A confirmation message appears to confirm that the purchase transaction was successful.
  • A summary of the order, sent by mail allows the Customer to check the details of the La Metropole Aix-Marseille Provence reserves the right to cancel or refuse any order of a customer with which there was a dispute related to the payment.

Annex 1 - Article 4 Order Confirmation

After the validation of the order, the dematerialized Transportation Securities are automatically credited to the customer’s “My Account”, heading “My Securities”.

Unused orders / securities are viewable from the securities portfolio home screen.

The Customer receives the order confirmation by mail at the address used for the creation of his/her account.

Annex 1 - Article 5: Use of the La Métropole Mobilité application

Use of the La Metropole Mobility app (including the old leticketapp) or the purchase of dematerialized transport titles

In order to travel with the dematerialized Transport Titles, the Customer must imperatively use the La Metropole Mobility mobile application (including the old leticket application) for smartphone. Dematerialized transportation titles are accessible in the “My Titles” heading of this application.

Before boarding a vehicle, the Customer must be in possession of a valid dematerialized Carriage Title and ensure that their smartphone has sufficient battery life to cover the entirety of their journey.

The validation of a Carriage Title is mandatory for travel.

It is strictly forbidden to reproduce, duplicate or counterfeit a Transportation Title in any way whatsoever. The reproduction of a Carriage Title and the use of the copy of the Carriage Title are liable to criminal prosecution.

Schedule 1 - Item 6 Control of Purchased Securities

Control of tickets purchased on the La Metropole Mobility mobile app (including the old leticket app)

Leticket is available on mobile in self-validation, with generation of a QRcode enabling a check.

A check of the dematerialized Titles of Transport shall be carried out at the request of a controller by a verification of the QR code displayed by the passenger on his/her mobile phone screen via the “Check” button.

The check-in agents are authorized to manipulate, in compliance with hygiene and sanitary safety measures, the Customer’s smartphone in order to proceed with a check-in within the rules.

In case of inability of the customer to present “Leticket”, his Title of transport dematerialized (insufficient battery level, low screen …), it will be verbalized for absence of title following violations in force on the lines of the affected network.

Annex 1 - Article 7: Property Reserve

The titles of transport remain the property of the Metropole Aix-Marseille-Provence until full and definitive collection of the price by the Metropole.

Schedule 1 - Article 8 Term

These Special Conditions of Sale apply for the entire duration of the online availability of the “Leticket” service offered by the Aix-Marseille-Provence Metropolis.

Annex 1 - Article 9: Liability

The Customer is responsible for the security of his smartphone and will therefore assume any risk of loss, theft or damage, whatever the cause.

In the event of an error by the Aix-Marseille-Provence Metropolis in the sales transaction, i.e., Transport Tickets not conforming to the Customer’s request, the Aix-Marseille-Provence Metropolis will replace the tickets, provided that its liability is established.

In accordance with article L121-20-03 of the Consumer Code, the Aix-Marseille-Provence Metropolis shall not be held liable in the event of non-performance or poor performance of the service attributable to the Customer or to the unforeseeable and insurmountable act of a third party not involved in the purchase of electronic transport tickets.
